This was confirmed by the judgment of the Supreme Court of October , reference number I PKN / , which ruled that the reinstated employee must hold the same position and perform the same duties for the same remuneration or different, if applicable . In the meantime, the company's remuneration regulations for a given position have changed. A decision on reinstatement recreates the original employment relationship and does not force the re-establishment of the employment relationship. The employer terminated her employment contract, and then, as a result of the court's judgment. The employment relationship was restored. The employer wants to give Mrs. Irena the position of a history teacher because there is a vacancy for this positio. This is against the regulations because Mrs. Irena was a Polish teacher and must be reinstated to the same duties. Obligations of an employee reinstated to work The employee's role is to notify the employer of his/her readiness to immediately start work within days from the judgment becoming final.
